And nothing stops a rival hotel briefing a supplier to make something in the same territory, which is what actually happens - not copying, but converging. The practical consequence is that any register admired widely enough to be worth protecting will have near-relatives on the market within a few years, and no contract you sign prevents that. So the correct response is not to buy stronger protection, it is to stop treating the composition as the asset. Three things are genuinely yours. The first is the name. If you call your register something, that name is a trade mark question, and it belongs with your legal team rather than your fragrance supplier. It is also more valuable than people expect, because a name is what a guest asks for at the front desk and what appears on a retail bottle, and a competitor with a similar smell and no right to the name has a much weaker position than one with both. The second is consistency, and this is the one we would argue matters most. It requires a written standard in outcomes rather than settings, one named owner per property, recorded settings with dates, seasonal changeovers, tracked bottle age, and quarterly verification by somebody who has come in from outside the building, because everybody who works in a hotel adapts to a steady background within about an hour and stops perceiving it, with adaptation running only one way. A competitor can buy the same bottle tomorrow. They cannot buy four years of a building smelling exactly the same way, and that is what a returning guest is actually recognising.
